“Site” means: the website www.agrofoodbic.it managed by Agrofood BIC and registered in the name of Agrofood BIC.

“User” and/or “you” means: any visitor and/or user of the Site.

The various sections of the site are handled by Agrofood BIC and /or any third parties as expressly indicated each time.
This agreement contains the terms and conditions relating to usage of the Site.

These terms and Conditions govern the user’s responsibilities and together with other aspects, the limits of the responsibility of Agrofood BIC. Before using the Website, please read the entire contents of the present general conditions of contract.

By using this website, you acknowledge and agree to the following terms and conditions set out below. In case of rejection of these terms and conditions we ask you not to use the Site and not to download any material from it.

Access to the website does not require any Personal Data. During normal consultation of this website some identification data are acquired whose transmission is implicit in the use of internet communication protocols. This information is not collected to be associated with specific individuals, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of computers used by users who connect to the site, URI addresses (Uniform Resource Identifier) of requested resources, the time of the request, the method utilised to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response from the server (successful, error, etc..) and other parameters related to the operating system and Users. These data are utilised only to obtain anonymous statistical information on Site usage and to check its correct operation and are deleted immediately after processing. The data could be used to ascertain responsibility in case of hypothetical computer crimes against the site.

The optional, explicit and voluntary sending of emails to the addresses on this site involves the subsequent acquisition of the sender’s address, necessary for responding to requests, and other personal data in the message, please refer to the article 13 of Italian Legislative Decree 196/2003 (“Privacy Code”) available in the various sections of the Site.

The User acknowledges that the information, data, software, photographs, graphs, videos, graphics, music, sounds, images, illustrations, drawings, icons, texts and any other material on the Site are Agrofood BIC’s and/or third parties’ copyrighted works, unless otherwise indicated.

Access to the site does not give the user the right to own, reproduce, modify, distribute, republish, in any form, in whole and/or in part, the information contained here unless expressly authorised in writing by Agrofood BIC. Copying, reproduction, even partially, downloading, saving, publication or circulation utilising any means and more in general any act of disposition or use of the information or material on the Website, in any form, through existing media and technologies or any developed in the future are prohibited, except for downloading of one copy of the materials indicated as downloadable on any single computer for your personal, non-commercial use only, provided you keep intact all copyright, trademark and other proprietary notices relating to author attribution and copyright.

Any software downloaded from the Site, as well as the files and images it contains or creates and the data accompanying any software are licensed by Agrofood BIC without this implying transfer from Agrofood BIC to the User of any rights relative to such software. The User owns the tangible medium on which such software is installed, but the ownership of the software and the intellectual property rights shall belong to the Agrofood BIC and/or third parties. The User is not allowed to distribute, break down, rip apart, decompile, disassemble and/or translate the software into a language understandable by people.

Allowed use of the Site

The User can use the Website only for legitimate activities, such as participation, through the Site, in any competitions organised by Agrofood BIC and consequently must not use the Site, as this is specifically prohibited, for any speculative and/or fraudulent activities.

Any use of any part and/or section of the Site, the information and/or the material available on the Site is expressly prohibited for commercial or advertising activities of any type, unless expressly authorised in writing by Agrofood BIC.

Users committing fraudulent or illegal acts shall be prosecuted pursuant to the law.

Warranties

No guarantee is given relevant to the fact that the use of this Website shall be exempt from errors regarding the accuracy, reliability or quality of any content relevant to the information, services and advice made available through the Site.

The User hereby expressly declares that his/her use of the Site is at his/her sole and exclusive risk.

Characteristics of the Site

Users from any part of the world can access the Website and the Website may contain references to services that are not available in the country of residence of the User. The existence of such references does not imply that Agrofood BIC intends to make such products available in the country of the User. Agrofood BIC reserves the right, without prior notification, not to make specific services available or to modify their characteristics at any time, without prior notification or obligations.

The content herein is published solely for informational purposes. Therefore, it is not and cannot be regarded as a sales proposal for Agrofood BIC’s products. The information made available through the Website may contain inaccuracies or errors.

The information contained in the Website may be subject to periodic changes. Agrofood BIC and / or its respective suppliers may make improvements and/or changes to the Site at any time.

Agrofood BIC and/or its respective suppliers do not issue any type of guarantee or declaration relevant to the suitability, reliability, absence of virus or any other components which may cause damage, inaccuracies in the information, of the services and the relative graphics on the Website.

Under no circumstances shall Agrofood BIC and/or its suppliers be held responsible for direct, indirect, moral, incidental, special or consequential damage or for damage of any kind including, as an example, damage for usage loss of data or economic profit deriving from or otherwise relating in any manner to the usage or execution of the Website, to the delay or inability to use the Site.

Under no circumstances shall the Company, its managers, directors, employees or associates, be liable for any injury, loss, direct or indirect damage of any type, either based in contract, tort, or in any way connected with any use of the Site that does not comply with these terms and conditions even if Agrofood BIC has been advised of the possibility of such damage.

Agrofood BIC is also free, without notice, to make changes, corrections, updates and improvements to the structure of the Site and to the information/documents on it. These interventions may result in temporary inaccessibility to the website and the permanence, on the same site, of outdated information, with respect to which Agrofood BIC disclaims any responsibility from now. Agrofood BIC cannot be held in any way liable for any errors and/or omissions that may occur in completing the Site.

If, notwithstanding the above, Agrofood BIC is held liable for any damage or loss relating to the use of the Site, the User agrees and acknowledges that the responsibility of Agrofood BIC shall not exceed in any case the cost (if any) incurred by the User while using the Site.

Reports and complaints

Agrofood BIC undertakes, if a sufficiently motivated request is sent by writing or e-mail, to promptly remove any material available on the Site that is proven to be the property of parties, other than the subject indicated as the author or the section provider and the latter may legitimately claim rights or interests in the material or its contents, or should the material or its contents damage any interest or right protected by law.

Termination of the service

AGROFOOD BIC MAY TERMINATE OR SUSPEND USER ACCESS TO ALL OR PART OF THIS SITE, AT ANY TIME, WITHOUT NOTICE AND AT ITS SOLE DISCRETION

Entire agreement

These terms and conditions represent the entire agreement between You and Agrofood BIC regarding your use of the Site and supersede any prior statement or representation.

AGROFOOD BIC RESERVES THE RIGHT, AT ITS COMPLETE AND EXCLUSIVE DISCRETION, TO MODIFY THESE TERMS AND CONDITIONS ANY TIME, PUBLISHING THE NEW TERMS AND CONDITIONS ON THE SITE. THE NEW TERMS AND CONDITIONS WILL BE VALID AND EFFECTIVE FROM THE MOMENT THEY ARE PUBLISHED ON THE SITE.

SITE USE BY USERS WILL BE GOVERNED BY THE TERMS AND CONDITION POSTED ON THE SITE AT ANY TIME.

Applicable law and jurisdiction

THESE TERMS AND CONDITIONS WILL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH ITALIAN LAW.

Any controversy arising from these terms and conditions will be subject to the exclusive jurisdiction of the Court of Bologna, Italy.

Il Titolare informa che i dati personali (quali nome, cognome, indirizzo di posta elettronica) raccolti nell’invio della richiesta di contatto, saranno trattati con modalità manuali, informatiche e telematiche unicamente per rispondere alla richiesta.

Il conferimento dei dati è facoltativo, ma necessario per la finalità sopra indicata; il mancato conferimento dei dati non comporterà nessuna conseguenza. I dati non saranno né comunicati, né diffusi.

In ogni momento, ha la possibilità di revocare ex art. 7 del Regolamento il consenso prestato, proporre reclamo all'autorità di controllo competente ex articolo 77 del GDPR (Garante per la Protezione dei Dati Personali), qualora ritenga che il trattamento dei suoi dati sia contrario alla normativa in vigore.
